What issues face a trial judge when a military defendant appears in court for an impaired driving offense? From the first question of "How does the trial judge even know the defendant is a servicemember?" to "What happens to the servicemember in the military while he is pending trial and after he is convicted and sentenced?," this webinar takes the trial judge from A to Z in exploring these unique issues.
Jurisdiction between military and civilian courts will touch upon the dual sovereign doctrine, and administrative double jeopardy policies and comity between the courts. How these cases may be handled under military law, either by non-judicial punishment imposed by a commander or prosecution under the Uniform Code of Military Justice in a court-martial, will give practitioners insight into a separate justice system with worldwide reach. Finally, we will identify administrative consequences to servicemembers related to deployment, reassignment, military education opportunities, separation and discharge from the service, bars to reenlistment, reduction in rank, driver license suspension, probation, and referral to substance abuse treatment programs.
