In June 2023, the United States Supreme Court issued a 5-4 decision in Arizona et al., v. Navajo Nation, rejecting the tribe's suit against the federal government in a dispute over access to the Colorado River system. Writing for the majority, Justice Kavanaugh found that the federal government was not required to take affirmative steps to secure water for the Navajo. The dissent, authored by Justice Gorsuch, disagreed and concluded that the federal government had violated the plain terms of the 1868 peace treaty with the Navajo, ignoring a real need to help the tribe secure water rights.
Panelists will discuss key takeaways from the majority and dissenting opinions, unresolved questions, what this might mean for the Winters Doctrine, and the Nation's most recent litigation to quantify its federal reserved water rights in the Little Colorado River system and source.
