On June 23, 2022, the Supreme Court issued its decision in New York State Rifle & Pistol Association v. Bruen, the most significant Second Amendment case decided by the Court in more than a decade. In a 6-3 ruling, the Court struck down New York's century-old public-carry law and announced a right to carry guns in public. The Court also announced a new framework for evaluating Second Amendment challenges, which requires governments to justify laws implicating Second Amendment rights through "historical tradition."
In the year following the Bruen decision, courts have faced an unprecedented number of Second Amendment challenges, while governmental officials at the federal, state, and local levels have been forced to grapple with the potential impact of Bruen on longstanding gun violence prevention policies and regulations. This presentation will explain the development of the Supreme Court's modern Second Amendment jurisprudence, including the Bruen decision, and the impact of the Court's decisions for policymakers and litigators. This presentation will also look ahead to upcoming Second Amendment challenges that the Supreme Court will likely consider in the near future.
