Concerns regarding "greenwashing" (commonly understood as false or misleading claims that make a product or business seem more environmentally friendly than it actually is) have grown in recent years, in part because of the expansion of ESG reporting and regulatory focus on environmental marketing claims in the United States and abroad. Action taken to address greenwashing by national government entities, including the U.S. Federal Trade Commission, European Union, and the United Kingdom Competition and Markets Authority, reveal enforcement trends of which lawyers, environmental professionals, and consumers should be aware. Further, in the U.S., governments at the state and local level have brought actions under consumer protection laws to curb greenwashing, and private litigation involving consumer claims has arisen in recent years. In short, the regulatory, litigation, and other business risks associated with green marketing and public reporting require the attention of the environmental legal community.
This panel will provide an overview and key insights regarding greenwashing history, case studies, litigation, and applicable domestic and foreign laws, regulations, and policies. The panel will open with a general overview of the concept of greenwashing here in the United States, related litigation, and lessons learned. The panel will transition to a discussion of regulatory and litigation activity internationally, including the European Union. The panel will conclude with a discussion of the anticipated scope of greenwashing regulation and litigation in the future, including the FTC's anticipated revisions to its Green Guides, as well as practical tips and takeaways for the environmental practitioner.
