Powering the Future: A Lawyer's Guide to Clean Energy
Three experienced and successful allocators will discuss the tools of their trade for getting obstreperous responsible parties to agree to funding mechanisms to pay for investigation and remediation costs at Superfund sites. They will identify best practices for gaining group acceptance and actions and positions that presage group rejection. In adopting the Comprehensive Environmental Response Compensation and Liability Act (CERCLA or Superfund) Congress sought to protect health and the environment, but from a practitioner standpoint, it's mostly about money. Significant sites require significant resources for investigation and remediation and the process of obtaining EPA decisions on these activities is cumbersome and expensive. Where a number of responsible parties are (jointly and severally) liable, their goal in forming a PRP group is not just to manage the investigation and remediation process, but to figure out how they will pay for it. This inevitably requires an allocation of those costs among the responsible parties, each of which believe that they are not liable and that other parties should bear the brunt of the costs. Because the difficulty of making these decisions resulted in wounding litigation, parties sought people who could mediate that discussion and help the parties arrive at some type of agreed allocation resolution. In this webinar we will engage with some of the best allocators in the business to talk about how they do their work. They will talk about the types of approaches most likely to arrive at successful resolutions and approaches most likely to prevent a group from reaching accord. They will also discuss the tools that the representatives of the responsible parties should bring to the table in order to achieve their goals and what tools tend to be less helpful. This is intended to be an open (but moderated) discussion where attendees of the webinar will also be able to ask questions of the participants.
