Foreign ownership of U.S. real estate has increasingly come under government scrutiny and is the focus of much federal and state legislation. While many practitioners are familiar with CFIUS' requirements, the Agricultural Foreign Investment Disclosure Act and state analogous statutes have reporting requirements related to the foreign ownership of certain real property with steep penalties for noncompliance. Additionally, more than 30 states have some form of foreign ownership restriction related to real property (most prominently, agricultural land) and many more states have some form of reporting requirement tied to same.
The ABA will seek 1.5 hours of CLE credit in 60-minute states, and 1.8 hours of CLE credit for this program in 50-minute states.
