The Legal and Social Ramifications of Pandemics on Civil Rights and Civil Liberties
In December 2023, the Colorado Supreme Court ordered the Colorado Secretary of State to remove presidential candidate Donald Trump from Republican primary ballots, citing as grounds Section 3 of the Fourteenth Amendment to the United States Constitution. In this program, the Standing Committee on Election Law has assembled a bipartisan panel of experts to go beyond the politics of this case and look at how it shapes the law surrounding a previously under-litigated Constitutional provision.

In December 2023, the Colorado Supreme Court ordered the Colorado Secretary of State to remove presidential candidate Donald Trump from Republican primary ballots, citing as grounds Section 3 of the Fourteenth Amendment to the United States Constitution. This provision, dating back to the Reconstruction Era and rarely used since, states that any person who "shall have engaged in rebellion or insurrection" against the United States is barred from holding federal or state office. This month, the Supreme Court unanimously reversed the Colorado Supreme Court's decision, in the process clarifying the scope of Section 3, who has the power to enforce it, and how they can do so.
In this program, the Standing Committee on Election Law has assembled a bipartisan panel of experts to go beyond the politics of this case and look at how it shapes the law surrounding a previously under-litigated Constitutional provision. The discussion will also cover how the decision will shape future usage of Section 3, possible ways Congress could act to enforce the provision, and other possible consequences of the decision on election administration by the states.
