Model Rules of Professional Conduct, 2024 Edition
Using interactive scenarios, this webinar will address legal ethics considerations for legal aid and pro bono lawyers engaged in remote legal practice, focusing on issues unique to legal aid and pro bono practitioners, such as how to meet the ethical obligation of communication with remote or transient clients. The pandemic drove public interest lawyers to adapt their practices to the use of remote client interaction, remote court appearances, and work-from-home arrangements. These new ways of practicing law implicate a range of ethical concerns for all lawyers, including a number of issues that are unique to the provision of civil legal aid and pro bono legal services. Using interactive scenarios, this webinar will address these legal ethics considerations for frontline attorneys as well as managers and supervisors. In addition to addressing the intersection of ethics and remote practice, including Model Rule 1.1 (Competence), Model Rule 1.6 (Confidentiality), and Model Rule 5.3 (Nonlawyer Assistance), panelists will focus on issues unique to legal aid practitioners and how to meet the ethical obligation of communication (Model Rule 1.4), with remote or transient clients. Experienced legal aid leaders will also explore how the ABA Standards for the Provision of Civil Legal Aid provide guidance to legal aid leaders and managers when it comes to ensuring that their organization is engaged in ethical practice in the ether.
