      This program explores various options as to how to remain ethical during negotiations when faced with a situation in which the ethics rules are unclear as to how to act. The presentation is in a role-play format; the moderator poses a number of hypothetical negotiation situations that raise one or more ethics issues, and the two panelists engage in "role-play" to demonstrate differing points of view about what the ethics rules require in that situation and how they should act in order to comply with the rules. The hypotheticals focus on common problems encountered during negotiation for which the ethics rules do not provide a clear answer and the panelists and the moderator provide a variety of options and approaches to remain ethical even when the rules do not appear to fit the bill.

      Learning Objectives:

      • Identify the ABA Model Rules that come into play during negotiation (whether formal negotiation or informal)
      • Recognize that when the Rules are not exactly on point, lawyers still have a duty to act ethically and professionally
      • Consider a variety of solutions in various negotiation scenarios to discharge your duties under the ethics rules
      • Know that even when a situation falls within a "gray area" in the ethics rules you can apply the principles underlying the rules to act ethically
