Since 1830, the United States Supreme Court has relied on dictionary definitions of words in the abstract to define what words mean in context. SCOTUS' use of the dictionary has exploded in recent years, and state appellate courts have followed suit. But what sort of guidelines are there for when, and how, to properly use a dictionary in appellate practice and appellate decisions? This panel, in an entertaining fashion, will address that dry issue, showing gaps in analysis, how some advocates and courts are using the dictionary well, but many are not. In doing so, this panel will provide helpful guidance for enhancing and improving how advocates and judicial officers look to the lexicon to work through thorny issues of textual application and interpretation.
