Judges should expect to "encounter" GAI. GAI or, more specifically, the various platforms that ingest data and "generate" an image or document in response to a "prompt," may create something "new." At the same time, whatever is created may lead to allegations that data was ingested without consent or in violation of various laws and to allegations that the "creation" invaded privacy or infringed on intellectual property rights. All this highlights a need for case management focused on GAI, complex discovery into the platform and image in issue, the central role of experts, and disputes about admissibility of GAI. This program will examine these and related topics. At the end of this program, attendees will:

Understand the nature of GAI and the causes of action that might arise from its use.
Recognize how discovery might be conducted of GAI and the role of experts in discovery of GAI.
Appreciate case management issues that might arise when GAI is a "feature" of litigation.
Understand how existingevidence rules can be used to address admissibility of GAI.
Appreciate prophylactic measures judges have taken to address GAI.
