Guardianship severely impacts an individual's constitutional and civil rights. When defending against a guardianship, it is the ethical responsibility of counsel to protect the due process rights of their clients and present a vigorous defense. However, many attorneys encounter ethical challenges when representing clients with diminished capacity in defending against a guardianship.
This webinar will provide a better understanding of the ethical responsibilities of counsel in defending against a guardianship, including their duties under the Model Rules of Professional Conduct. The webinar will also help attendees understand and identify undue influence and provide possible options available if attorneys suspect undue influence is present in a guardianship.
The ABA will seek 1.5 hours of CLE credit in 60-minute states, and 1.8 hours of CLE credit for this program in 50-minute states.
