      The statistics are alarming. Surveys suggest that an unsettling percentage of lawyers and law students struggle with alcohol or substance abuse or anxiety or other stress symptoms. Lawyer well-being should be top of mind for all of us. Lawyers in need of assistance should be as well. What are our ethical obligations as lawyers in need of assistance or with whom we work or encounter? That's the question we will answer in this program.

      Learning Objectives:
      1. The application of Model Rules 1.16(a), 1.1, 1.3, 5.1 and 5.3, 1.6, 8.3, and 8.4 (among others) to situations involving lawyers in need of assistance will be explained.
      2. ABA Formal Ethics Opinions 03-429 and 03-431 will be discussed, dealing with duties of lawyers in the same or a different firm as a lawyer suffering an impairment.
      3. State and City Bar Ethics Opinions addressing a number of everyday scenarios that lawyers might encounter will be interwoven in the presentation.
      4. An explanation of how Lawyer Assistance Programs operate and the confidential nature of LAP communications will also be explained.
