The last two administrations have entered office behind the air toxics "8-ball" inheriting a host of missed statutory deadlines to assess, and if necessary, address residual risk after federal air toxics technology standards (MACT) were implemented at a cost of hundreds of millions of dollars for many industries. The resulting court cases have made EPA's life difficult, potentially requiring the revision of MACT standards to address pollutants not previously regulated. In meeting these obligations, the use of fenceline monitoring has come to the forefront - and with the truism that "knowledge is power," the data generated will bolster environmental justice evaluations and potentially new regulation. This panel will explore the critical legal issues facing EPA in these regulations, the role of environmental justice, and the likely activity and key legal decisions before the election. They will answer questions like: How will the administration manage the tremendous workload while ensuring sound decision-making? What will the fenceline data lead to?
