This panel will discuss risks facing consumer products manufacturers as states (and EPA) expand reporting requirements and begin to directly regulate certain product classes and plaintiffs grow bolder with consumer protection and false advertising claims. Panelists will compare new and upcoming reporting schemes in Maine, California, Colorado, and other states and discuss implications of removing de minimis exceptions for PFAS listed in the Toxics Release Inventory. Panelists will also compare new and proposed state laws and regulations in California, Washington, New York, Minnesota, and other states that directly ban or otherwise restrict manufacture and sale of products that contain PFAS, and discuss implications of these bans for litigation. In addition, the panel will explore the wave of recent lawsuits alleging businesses misled consumers by promoting their products as "sustainable" or "natural" despite containing PFAS. The panel will feature practitioners and other professionals from a state regulator, an NGO, an outdoors equipment manufacturer, and private practice.
