PFAS regulation and potential liability is a quickly evolving topic in environmental law as state agencies, the federal government, and the plaintiffs' bar get more aggressive in their pursuit of regulation and culpable parties. This panel will discuss initiative-taking potential mitigation approaches in advance of and as part of transactions (regulatory) and regulatory enforcement/requests for information/litigation scenarios. Potential mitigation topics will include: transactional diligence and contractual terms; use of internal audits/desktop reviews of historic and current PFAS use/supply chain to evaluate potential risks/liability exposure, including identifying potential receptors; best practices for responding to requests for information/requests to sample (groundwater, stormwater and industrial discharges, remedial investigations); and evaluation of current and proposed state and federal laws and regulation. The panel will feature an environmental consultant and private attorneys with experience addressing potential PFAS liabilities in the course of transactions, regulatory enforcement and litigation.
