This panel will discuss the basics of agency rulemaking authority through the lens of recent regulatory developments involving PFAS. The panel will explain the statutory authorization for government agencies, like EPA, to issue new rules and regulations about PFAS issues-and it will explore how the judiciary is likely to view that authorization going forward, especially given recent Supreme Court precedent on the major questions doctrine and the uncertain future of Chevron deference. The panel will also discuss the current posture of federal and state PFAS regulations and designations, what is on the horizon, and how to advise clients about what the PFAS regulatory posture means for them. Panelists will include practitioners with significant experience in administrative law and PFAS regulations.
