Insurance Law for Common Interest Communities: Condominiums, Cooperatives, and Homeowners Associations
In this eCLE we will have Christina Martin, the lawyer with the Pacific Legal Foundation who argued this case to SCOTUS, talk about the background of the case, the SCOTUS opinion, any unresolved issues (i.e. the source of property rights and the excessive fines argument), and any other thoughts or perspectives on the case.

In Tyler v. Hennepin County, Minnesota, the County seized a condo and sold it for $40,000 to satisfy a $15,000 outstanding tax debt. The County then retained the remaining $25,000 in home equity. Tyler sued the County alleging the County's retention of the $25,000 in home equity was an unconstitutional taking. The District Court and Eighth Circuit ruled in favor of the County. Tyler appealed to SCOTUS and in a landmark unanimous opinion SCOTUS overturned the District and Circuit Courts, holding the retention of the home equity was an unconstitutional taking.
The ABA will seek 1.5 hours of CLE credit in 60-minute states, and 1.8 hours of CLE credit for this program in 50-minute states. Credit hours are estimated and are subject to each state's approval and credit rounding rules. Please visit www.americanbar.org/mcle for general information on CLE at the ABA.
