When public entities are sued, their actions are not only scrutinized in the litigation process but often in the media, and the public eye. This program will help lawyers who represent public entities manage the litigation process both internally and externally, while complying with the rules of professional conduct. Attendees will learn how to: identify the unique challenges facing public entities including open records laws and the Freedom of Information Act, as well as several exemptions under these types of laws; differentiate between political, policy, and litigation goals; understand free speech protections for public employees; identify applicable Model Rules of Professional Conduct including Model Rule 3.6 (trial publicity); Model Rule 3.8 (f) (special responsibilities of a prosecutor); and Model Rule 8.4 (c) and (d) (misconduct).
