This program will review the current challenges to collection of information, copyrighted or otherwise, for use in machine-learning produced models, including the large language models underlying ChatGPT and diffusion models underlying image-generating platforms. Included in the discussion will be the interaction between contracts and other claims to proprietary information, including trade secrecy (such as CompuLife) and common law and statutory rights of privacy and publicity, as well as First Amendment and competition law claims to access to public-facing information.
