The discussion will include:
- Is the trust director a fiduciary? What is the extent of the director's liability?
- Is the duty to follow the director absolute?
- Can the directed trustee reduce their own liability for bad decisions of the director by keeping the beneficiaries informed?
- What does keeping them informed look like? Does it include accounting if the directed trustee isn't responsible for decisions about investments or distribution?
- Should the director reduce liability by keeping the beneficiaries directly informed - for example by sending statements?
- What specific types of powers can a grantor assign to a director? Is there any limitation on the power that a grantor can instill in their trust director?
- Is the director entitled to commissions or some other form of compensation?
- The power to "direct" traditional trustee roles of a trustee vs. the power to "protect" the trust by exercising a power that is not traditionally held by a trustee.
- A review of the model law under the Uniform Trust Code governing directed trusts and the Uniform Directed Trust Act, as well as the adoption of that model law.
The ABA will seek 1.5 hours of CLE credit in 60-minute states, and 1.8 hours of CLE credit for this program in 50-minute states.
