A Court Divided: October Term 2023
Generative artificial intelligence (GAI), of which ChatGTP is a prominent example, bursts onto the popular imagination in late 2022. Fueled by internet data, including copyrighted works, it and other GAI are being used to generate text that mimics human-authored content. GAI can create images of persons and objects that incorporate what is "real" and what is manipulated or contrived. This CLE program will delve into the nature of GAI, consider how it might be used or misused, and address causes of action that might be brought arising out of GAI. Panelists will also discuss the ethical implications of GAI for attorneys and judges.

Generative artificial intelligence (GAI) is being touted as an excellent tool for attorneys and their clients. GAI functions through the sifting through of data sets to create "original" content. That process may implicate privacy issues arising out of the use of personal data as well as confidential corporate data, all of which might lead to claims of, among other things, copyright or trademark infringement. This CLE program will address the use and potential misuse of GAI. It will also consider how the Model Rules of Professional Conduct might apply when attorneys use GAI. At the end of the program, attendees will:
