Using the Model Rules of Professional Conduct and various ABA Ethics opinions, this presentation will discuss how lawyers' ethical responsibilities impact their use of technology tools including artificial intelligence, e-discovery, zoom or similar platforms, and contract review tools. Lawyers' core duties to clients do not change: competence (M.R. 1.1), communication (M.R. 1.4), confidentiality (M.R. 1.6), candor (M.R. 3.3, 3.4, 4.1), and avoidance of conflicts (M.R. 1.7, 1.9). So how can lawyers best incorporate technology taking advantage of its benefits, while avoiding the attendant risks? What role do lawyers' supervisory obligations play in the use of these new technologies (M.R. 5.1-5.3)?
