The Future of Bankruptcy Sales: What Are the Implications Now that the Supreme Court Has Determined That 363(m) is Not Jurisdictional? [CC]
On April 19, 2023, the Supreme Court in MOAC Mall Holdings LLC v. Transform Holdco LLC unanimously determined that Bankruptcy Code section 363(m) is not jurisdictional. Bankruptcy Code section 363(m) is a statute designed to ensure the finality of section 363 sales by preventing the validity of the sale from being "affected" on appeal if the purchasing party acted in good faith. In this 60-minute webinar, speakers Jason Binford and Ashley Champion will discuss the MOAC decision, and the potential for the Court's decision to ripple across both the substance and procedural aspects of future 363 sales.
