Closed Captioned.
The perception of a zealous litigator is often combative and antagonistic, yet often the most obstructive litigators are the least effective. Repeated, unnecessarily adverse interactions with colleagues, whether you're the cause or the subject, can lead to (or is the result of) job dissatisfaction, burnout, or even formal reprimands. When your opposing counsel's "zealous" approach leads to heated debate or obstructive behavior, it can be frustrating and difficult to maintain composure. Our experienced panelists will guide us through how to ethically litigate a case while still advocating zealously for our clients, as well as how to respond to unreasonable behavior or demands from opposing counsel who may not have considered their own obligations to adhere to the fundamental standards of professionalism and civility. Model Rules 1.3 (Diligence) and 3.4 (Fairness to Opposing Counsel) are among the Model Rules to be covered.
