Gatekeepers 201: Ethics, Due Diligence, and the Influence of European Confidentiality Limitations [CC] — CLE 90 min

The webinar will discuss current proposals to amend the Model Rules of Professional Conduct with specific reference to anti-money laundering (AML) and related concerns against the backdrop of existing ethics rules regarding client confidentiality, scope of representation and lawyer due diligence, and declining or terminating representation. The webinar will briefly recount the history of efforts (emanating largely from the OECD's Financial Action Task Force) to involve the U.S. legal profession in the AML struggle, summarize recent developments such as the Corporate Transparency Act and regulatory initiatives by Treasury's Financial Crimes Enforcement Network (FinCEN), and assess arguments by proponents of Model Rule amendments that the future of self-regulation of the legal profession is in danger if focused, AML measures are not incorporated into the Model Rules.
