PFAS are a group of man-made chemicals that have been in use since the 1940s. PFAS have been found in a wide array of everyday consumer products such as cookware, food packaging, and stain and water repellents used in fabrics, carpets, and outerwear. In recent years, concerns over the potential adverse human health and environmental effects of PFAS have grown, largely due to the pervasive and persistent nature of these chemicals. Most people have been exposed to various levels of PFAS, which may gradually accumulate and remain in the body over time. As public concern regarding PFAS has grown, so too has the PFAS litigation landscape. This panel will provide a constructive overview and key insights regarding the general history of PFAS manufacturing and use in specific products, when and where PFAS litigation and regulation began, the present scope of PFAS litigation and regulation, and where we expect PFAS litigation and regulation to expand in the future. The panel will begin with a discussion of high-profile individual complaints and class actions filed against manufacturers and processers of PFAS in the early 2000’s, some of which have settled for hundreds of millions of dollars. The panel will then transition to a discussion of the present scope of PFAS litigation, including actions brought by state attorneys general, aqueous film-forming foam multi-district litigation, and PFAS product liability and false advertising cases. The panel will conclude with a discussion of the anticipated scope of PFAS litigation in the future, especially in light of the EPA’s and states' increased focus and ongoing efforts to aggressively regulate PFAS. What downstream companies and industries will be the targets of PFAS litigation? Where will public enforcers focus their attention? What types of claims do we expect private plaintiffs to bring? All of this, plus more, will be discussed regarding a group of chemicals that is certain to impact businesses, individuals, and government entities for decades to come.
