Whether you're a criminal defense specialist or a general practitioner who handles the occasional criminal case, you have no doubt run into knotty ethics issues in your practice. There are a host of ethical issues that can arise in a routine case. What if someone brings you physical evidence that could incriminate your client? What if the prosecutor tells the judge your client has no record when she does? What if you suspect your client is calling you from jail using a contraband cell phone? What do you do if your client seemed competent when they hired you, but now shows signs of mental incapacity? How should you deal with a client who wants you to hold a press conference and profess his innocence? Should you try to discredit a truthful witness? What if your client is insistent that you call a witness who you suspect will lie? The list goes on. A panel of experts will address these issues and others, discussing ABA Model Rules 1.2, 1.4, 1.6, 1.14, 3.3, 3.4, 3.6 and 4.4. Amanda Clark Palmer, a partner at Garland, Samuel & Loeb and Wayne McKenzie, General Counsel for the NYC Department of Probation, along with Jenny Mittelman, Deputy General Counsel for the State Bar of Georgia, will be your guides.
