The U.S. energy industry is in a period of rapid transition toward what many believe will be an entirely new paradigm. Utilities are learning how best to comply with mandates to decarbonize the grid within the strictures of market and financing realities. Many local, state, and federal agencies are implementing policies intended to foster greater deployment and integration of renewable resources; interstate and local electric systems are interacting with one another more frequently than they ever have before; and customers are increasingly participating in the generation and sale of energy through adoption of distributed energy resources, challenging traditional generators. This panel will focus on this new paradigm and its impact on law and policy, including how various stakeholders (e.g., utilities, transmission providers, and local, state, and federal regulators) will coordinate with each other to ensure seamless management and operation of the grid; how the existing legal regime, and its division of regulatory authority between federal and state governments, will be challenged and evolve; and how these new complexities, especially more frequent interactions between interstate and local grids and federal and state regulators, impact how lawyers advise clients on energy and related environmental issues.
