This webinar will examine the nuts and bolts of the joint-defense agreement in the criminal context. The panel will discuss the tactical benefits of joint-defense agreements, as well as their potential pitfalls, and offer best practices for navigating the very real complexities associated with joint-defense-agreements. Among other topics, our discussion will explore:
- The key elements of a joint defense or common interest agreement in a criminal matter and the benefits they provide;
- The circumstances in which a joint defense /common interest agreement might be discoverable and the strategies for mitigating the risk of disclosure;
- Defense counsel's rights via joint defense /common interest arrangements when interacting with government counsel;
- The circumstances in which parties must withdraw from joint defense /common interest agreements; and
- Concrete examples where the above principles are applied.
At the conclusion of this program you will be able to understand theory and apply it to practical situations. You will be able to understand the elements and boundaries of the JDA and, moreover, tactical ways to apply that knowledge in a variety of situations.
