The rules of professional conduct govern a lawyer’s duty to supervise others, including more junior attorneys and staff. But in practice, the duty to supervise can be challenging to understand. For partners, how much attention must they pay to the work of their associates? Is it reasonable to trust a junior lawyer’s work product without checking behind it? How much supervision – in light of costs to the client and the risk of micro-managing – is appropriate?
For associates, there are similar questions when supervising more junior professionals, including staff. Although staff may not be subject to the same ethical obligations as the associate, that associate bears an ethical obligation to ensure that staff’s work does not breach any rules. Situations in which an associate is being supervised by a more senior attorney also can create challenges, such as when an associate identifies a potential ethical issue with the conduct of the more senior attorney or when an associate is asked to complete a task that the associate believes is unethical. Is the associate required to disclose her or his concerns to others? What does that reporting look like?
Christopher R. Blazejewski a partner at Sherin and Lodgen, Josephine M. Bahn, an associate at Cozen O’Connor, and Alanna Clair, a partner at Dentons will examine practical tips for how to supervise and be supervised, particularly in the era of remote working, in which face-to-face work may be less common. Courts and bars are also evolving in how they treat the duty to supervise, which has not always been an issue on the cutting edge. By learning the ethical requirements and some practical guidance for how to utilize those requirements in practice, lawyers will be well-equipped to comply with Model Rules 5.1 and 5.2.
