"Pool Counsel"- or one lawyer/law firm representing multiple witnesses in the same investigation - is becoming increasingly common in white collar matters such as corporate internal investigations, government investigations, or civil discovery. Criminal and civil defense counsel as well as members of general counsel offices will benefit from this CLE examining the ethical considerations of such representations, including best practices for establishing and conducting a pool representation. The program will focus on strategies for accomplishing client objectives while recognizing and avoiding ethical risks posed by potential conflicts of interest and protecting client information and privileges. Attendees will get an overview of some best practices for conducting initial meetings with prospective clients, identifying conflicts, making disclosures, obtaining informed consent and discussing advance conflict waivers. This program will also provide insight into the advantages and disadvantages to prospective clients of joining a pool, ethical considerations for counsel involved in multiple representations, the effectiveness of advance waivers and what can happen if a pool counsel representation is challenged in court. The presenters will provide an overview of applicable ethical standards, sample retainer letter language, and practical guidance for handling multiple representations. Learn what to do at each step of your pool counsel representation and how to avoid mistakes - register today!
