The sharing economy raises questions regarding the allocation of authority between the states and their political subdivisions. Because short-term rentals (STRs) usually occur on land incorporated into a municipality, regulations frequently emanate from the local level of governance. This panel will examine (1) the ways in which cities have sought to retain control over STRs, including zoning, (2) preemption efforts from the states, and (3) the challenges faced by municipalities and STR operators to meet local expectations.
