Senators Leahy and Cornyn introduced a new bill, the Restoring the America Invents Act, to address what they perceive as "problems for small businesses and ordinary Americans caused by poor-quality patents." If enacted, this bill would dramatically change practice before the Patent Trial and Appeal Board by expanding the grounds that parties can raise in AIA trials and placing limits on the Director's discretion to deny institution of these proceedings. Post-issuance proceedings are not unique to the U.S. Major patent regimes around the world, including Europe and Japan, utilize similar proceedings to scrutinize issued patents. A panel of experienced domestic and international patent practitioners will compare and contrast select international frameworks and offer insights and statistics that may offer best practices for implementing an effective review system in the United States.
