The Chairman of the Board of Purdue Pharma, Steve Miller, and leading insolvency practitioners Laura Davis Jones and James Conlan, are joined by Bankruptcy Judge Sage Sigler to discuss legal and strategic considerations for non-debtor parties to obtain non-debtor third-party releases. The panel discusses the background and development of the case law regarding the granting of non-debtor releases in Bankruptcy cases, and Mr. Miller recounts his experiences as Chairman of the Board of Purdue Pharma beginning with his appointment in 2018 through Purdue’s chapter 11 case. Finally, the panel discusses where Courts are headed in this controversial area, the latest negotiations and cases regarding third party releases, the pros and cons of third party releases, and what the United States Supreme Court might do if it has the opportunity to hear the case.
