A Court Divided: October Term 2023
Under the best circumstances, a legal dispute can be exhausting, scary, and isolating, and can significantly reduce the benefit of an eventual legal victory. This program walks attorneys through steps to reduce litigation stress in their clients, such as ensuring that their goals are clear, they are well informed regarding the litigation process, and have adequate outlets for their emotions.

Law is a crisis profession, yet most lawyers fail to recognize the strain crises put on clients and on themselves. Lawyers receive virtually no training in how to address crisis as a potential form of trauma and longstanding emotional harm. In fact, litigation and the underlying issues that lead to it can create effects similar to PTSD. A good 'bedside manner' can significantly reduce this stress among clients but is generally not part of a lawyer's professional education. Fortunately, we have the power to significantly mitigate litigation stress. This presentation equips lawyers with tools to understand and respond to the emotional landscape of a business crisis.
