As the COVID-19 Pandemic moves into "the next phase" and supply chain disruptions continue, cash flow management is increasingly critical in all sectors of the economy. A growing number of businesses face more pressure to actively collect their receivables so they can pay their payables. Bankruptcy filings fell sharply during the first year of the pandemic, but government relief packages are expiring and cash flow shortages are expected to lead to potentially record-level filings in 2022 and beyond. Businesses extending credit, and pursuing collection of their receivables, need to know their rights when it comes to collections and, in worst-case scenarios, in bankruptcies. This webinar will explore the current economic conditions and then dive into the Uniform Fraudulent Transfer Act ("UFTA"), the Uniform Voidable Transaction Act ("UVTA") and 11 USC §548. The 11 USC §548 discussion will detail thereasonable equivalent value standard and the solvency tests. Each of the three solvency tests - balance sheet, cash flow, and adequate capital - will be discussed, as well as the need for experience and accuracy in court presentation.
The presenters include two bankruptcy litigation attorneys, a crisis management and turnaround consultant, and a forensic accountant/expert witness.
