Mediation is often under-utilized in the federal courts, despite providing a free, and frequently mutually beneficial, means of successfully resolving contested civil matters. Judges can provide a path toward resolution that might otherwise seem impossible, even on the eve of trial. But they can only help if the parties are open to settlement, prepared, and ready to be candid with the judge about necessary prerequisites to settlement.
A stellar panel that includes experienced federal judges, a private mediator, and civil litigators will share advice about how to maximize the effectiveness of these judge-moderated conferences. Advice and guidance will be given with respect to joint mediation statements, mediation techniques, dealing with difficult parties. At the end of this program, attendees will know:
