    During this 3-hour CLE program, seasoned panelists will teach you the ins and outs of special education law for students with disabilities, while also highlighting unique challenges faced by military families traversing the special education process. This course will educate practitioners regarding the requirements of a Free and Appropriate Public Education (FAPE) for individuals whose education is adversely impacted by their disabilities. Attendees will journey from the eligibility and evaluation process through the development of an Individualized Education Program ("IEP") and possible remedies when disputes arise between families and education agencies. By highlighting common issues, participants will learn how to navigate the special education process, avoid common pitfalls, and resolve disputes.

    This program will explore considerations for military families, including the following:

    • Section 504 of the Rehabilitation Act of 1973, Individuals with Disabilities Education Act ("IDEA"), and the Americans with Disabilities Act;
    • Eligibility process for a 504 Plan, IDEA, and IEP;
    • Development of an appropriately ambitious IEP, based on Endrew F. v. Douglas County School District;
    • Additional protections for students with disabilities in disciplinary actions; and
    • Dispute resolution, including exhaustion of remedies under Fry v. Napoleon Community Schools.

    Through this program, attorneys in the military will have a better understanding of how to engage clients within the constraints of specific military legal assistance programs, while attorneys in the private sector will have awareness about approaches for meeting the legal assistance needs of military families with special needs.

    Note that this program will have three one-hour sessions, including 10-minute breaks between each hour session.
