This program will describe the proposed federal central panel, a centralized adjudicatory structure for a variety of federal administrative agency matters. Panelists will describe the federal Administrative Procedure Act and the long-standing merit hiring system for federal administrative law judges. Panelists will present policy-based arguments and concerns regarding potential ramifications and unintended consequences of a federal central panel. Panelists will explain certain U.S. Constitutional authority for certain administrative law judges in the federal system, under Article II and Article I. At the end of the program, attendees will:
Learn U.S. Constitutional authority for certain administrative law judges (ALJs) in the federal system
Understand the Administrative Procedure Act (APA) and how and why it ensures fair and impartial hearings and decisions based on the law applicable to each case
Understand the arguments for and against a centralized federal adjudicatory system
Understand the long-standing merit hiring system for federal administrative law judges
