In July 2021, President Biden issued an Executive Order encouraging the DOJ and Department of Commerce to consider revising the 2019 “Policy Statement on Remedies for Standards-Essential Patents Subject to Voluntary F/RAND Commitments." On December 6, 2021, the DOJ, PTO, and NIST issued a new draft policy statement concerning SEPs that seeks to promote good-faith licensing negotiations and addresses remedies available to patent owners that have agreed to license their SEPs on fair reasonable, and non-discriminatory (FRAND) terms. This program will explore the different views offered by various industry stakeholders, and discuss how the U.S. patent, standards, and competition policies can help to effectively balance the interests of SEP holders, downstream innovators, and consumers in the voluntary consensus standards process.
