Family Advocate Fall 2021: Vol. 44, No.2
Divorced spouses, especially women, face numerous obstacles that can prevent them from accessing the retirement benefits to which they are legally entitled. Among these obstacles is difficulty accessing disclosures needed to obtain a Qualified Domestic Relations Order (QDRO), a court order that allows an ERISA plan participant's earned retirement benefits to be divided between the participant and his or her spouse at divorce or legal separation. The QDRO process is complex, and effective drafting requires access to plan documents and information. The 2021 ACEBC Pension Simplification Award-winning paper, authored by Emily Spreiser, raises this issue, and advocates simplification of the process by which former spouses of participants in ERISA-covered retirement plans obtain the documents and benefits information necessary to produce a properly drafted Qualified Domestic Relations Order (QDRO). The panel will discuss the problems raised in the paper, possible solutions, and the impact that adoption of these recommended changes may have on stakeholders, including former spouses, plans, and participants.
