This program considers party capacity from a broad perspective. The topic includes mediations about capacity (i.e., guardianship mediations) and cases in which a participant may not have capacity that do not otherwise concern capacity. This program will also cover issues relating to intimate partner abuse and how power imbalances may lead to incapacity. The program will provide insight primarily from mediation ethics - where party autonomy and self-determination are central tenets. In addition, the program will consider issues relating to disability law and discrimination. After discussing the ethical and legal implications of incapacity, the presenters will provide tools and techniques for assessing whether mediation parties can exercise their right to self-determination. The panelists will provide practical advice and tools that should apply whether the mediation occurs face-to-face or with the assistance of technology.
