It is easy to be cynical about industry self-regulation, but when developed and implemented properly, it can be a powerful tool for enhancing consumer trust in business. Independent industry self-regulation is a voluntary, yet accountable system where an organization such as a trade/membership association, professional society, or a nonprofit organization, as opposed to a government or firm-level organization sets standards for an industry, monitors the industry for compliance, and enforces those standards when issues of non-compliance arise. An often-overlooked component of a successful self-regulatory model is the role of alternative dispute resolution (ADR) in allowing businesses to resolve conflicts. This session will provide attendees with an in-depth look into how some of the more prominent ADR systems have been set up in the U.S., as well as how they have adapted to their processes to go virtual in light of the COVID-19 pandemic. Some of the ADR systems this session will cover could include 1. Independent industry self-regulation, via the National Advertising Division (NAD); 2. Co-Regulatory self-regulation program, via Privacy Shield; and 3. Third-party independent ADR program, via BBB AUTO LINE.
