The Covid-19 Pandemic required the EEOC to transition to Online Dispute Resolution ("ODR"). First, external program evaluators will present robust data establishing that ODR is successful across a wide range of measures. Then, a panel of experienced EEOC mediators will address these results. This presentation will raise the issue of whether mediation returns to an in-person format or evolves into new patterns of mediation service.

Attendees will be presented with detailed and consistent measures on participant satisfaction and case resolution, from evaluation of in-person mediation in 2000 up to recent ODR data. There is also new data on ODR specific issues at EEOC. Attendees will see how ODR is different from in-person mediation, the advantages it offers, whether anecdotal opinions about reading body language and "Zoom Fatigue" are accurate, ODR flexibility and new tactics. With this foundation, the panel practitioners will discuss their ODR experiences, the data and also address contemporary legal and practice issues, Covid era issues, and the EEOC's guidance on providing reasonable accommodations for religious or ability challenges. They will also provide insights on how to best participate in these forums and how ODR can help their clients. The audience will be asked to provide its insights into the future of ODR.
