This program is for advocates and arbitrators to consider a wide range of questions that have arisen in the now prevalent hybrid and virtual format for arbitration proceedings, including these: How should advocates counsel clients on the advantages and disadvantages of virtual and hybrid hearings? What factors will influence whether parties will prefer that preliminary hearings, motion practice, the appearance of witnesses at hearings be conducted in-person or virtually? Do virtual hearings always save time and money? Do in-person or hybrid or virtual proceedings provide comparatively more value? Do in-person proceedings provide a better opportunity for clients to participate, to evaluate the progress of the case, to assess the opposing parties' and the arbitrators' views of testimony and evidence? How is advocacy affected by virtual proceedings? Is an advocate better able to examine key witnesses on long and complex direct and cross-examinations in-person? Does virtual advocacy demand new skills from lawyers? How can the challenges of advocacy in virtual proceedings be addressed? Is the performance of the panel of arbitrators affected by differences between virtual and in person proceedings? Does the process of an in-person hearing create better opportunities for communication between opposing parties and settlement? Should the dispute resolution clause address the use of in-person, hybrid or virtual proceedings for specific purposes?
