The Law of Class Action: Fifty-State Survey 2025
The panel will discuss a number of recent ESOP cases brought by the DOL and private litigants, as well as discuss most recent settlement agreements entered into by and between fiduciaries and the Department. The presentation will further discuss the DOL's more recent use of "book of business" investigations opened with respect to service providers to ESOPs and the trajectory of this process. The group will also discuss 2021's significant level of transaction activity and explore certain transaction structures. The panel will be comprised of legal counsel practicing in the ESOP transactional space and a valuation expert, allowing for a candid discussion as to thoughts and perceptions on the ever-changing legal landscape for ESOPs
