The federal government���s recent announcement of its first-ever water shortage declaration in the Colorado River Basin may be a harbinger of future water issues both in the West and across the United States. As tribal, state, and federal officials grapple with diminishing water supplies, ongoing drought conditions, and the broad impacts of climate change, Tribes continue to face challenges to their water rights and to ensuring that tribal citizens have access to sufficient water for domestic, agricultural, and other uses. Meanwhile, efforts by Tribes to access and protect critical groundwater supplies have met legal challenges and other roadblocks.
This panel will analyze developments in tribal water law through the lens of recent court decisions involving Tribes��� attempts to assert and use their federally reserved rights and the Ninth Circuit���s April 2021 decision finding that the United States has a trust responsibility to uphold Tribes��� Winters doctrine rights. Panelists will also discuss the difficulties Tribes face in protecting their water rights and bringing water to their citizens during an era of climate change, drought, and dwindling water resources.
