The complex intersection of federal Indian law and environmental law can create uncertainties over which government issues permits, whose water quality standards control permit conditions, and which agency certifies compliance. EPA’s regulations and policies that promise respect for the federal trust responsibility, tribal sovereignty, treaty rights, and environmental justice attempt to lay out approaches but sometimes lack concrete requirements. Panelists will discuss this complicated regulatory environment, the impacts to the regulated community, and the health and welfare of indigenous people as new federal initiatives seek to reinvigorate the Clean Water Act in and around Indian Country.
