The Clean Energy Transition is vital to tackling climate change, but it depends on natural resources that are often located in the Global South and Indian country. The urgency associated with the clean energy transition threatens a new wave of extractive colonialism impacting Indigenous communities both in the United States and abroad. Acquiring these materials, such as lithium (an essential component in lithium-ion batteries used in electric vehicles), oftentimes results in the impairment or destruction of culturally important sites, vital ecosystems, and critical natural or cultural resources. To address these issues, many actors-Indigenous, state, corporate, and more-are adapting existing regulations, engaging in policymaking, and adopting frameworks developed by civil society or intergovernmental organizations, such as the United Nations.
This panel will explain the obligations of both governments and corporate actors towards Indigenous peoples under treaties (e.g., Free Prior Informed Consent (FPIC)), customary international law, and standards of corporate governance, including environmental, social, and governance (ESG) principles. The panelists will discuss key legal instruments, landmark cases, and the growing trend of Indigenous peoples demanding that state and corporate actors engage in consultation and obtain explicit consent from impacted Indigenous peoples. Attendees will consider what lessons from the international context legal practitioners and tribal, federal, state, and local policymakers can draw as potentially applicable and relevant to Indian country in the United States.
